Promulgate Decision No. 252/QĐ-BTNMT establishing the National EPR Council

The Minister of Natural Resources and Environment has promulgated Decision No.252/QĐ-BTNMT establishing the National EPR Council. This is a cross-sectoral cooperative organization assisting the Minister of Natural Resources and Environment in managing, supervising, supporting the implementation of the responsibilities of exporters and importers (EPR) for recycling products and packages, collecting and treating waste.

Task in State management, supervising, supporting the implementation of EPR

Established according to Article 88 Decree 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing a several of Article of the Law on Environmental Protection, the responsibility of National EPR Council is to advise, assist the Minister of Natural Resources and Environment in managing, supervising, supporting the implementation of the responsibilities of exporters and importers (EPR) for recycling products and packages, collecting and treating waste according to the regulation of law.

The next responsibility of National EPR Council is to advise, assist the Minister of Natural Resources in managing, using financial contributions to support the recycling of products and packages, collecting and treating waste of exporters and importers.

Implement this responsibility, the National EPR Council will organize the establishing criteria, priorities, financial support levels for recycling activities, treating waste activities and proposal the Minister of Natural Resources and Environment shall consider and approve to announce public; appraise and vote to approve requests for financial support for the activities of recycling products and packages, the activities of treating waste of agencies and organizations according to the regulations of law and submit them to the Minister of Natural Resources and Environment shall consider and approve; through the Regulation on management and use of financial contribution to the Vietnam Environmental Protection Fund for recycling support by producers and importers and submit them to the Minister of Natural Resources and Environment shall consider and promulgate.

The National EPR Council is also responsible for organizing formulation and implementation of plans, reporting to the Minister of Natural Resources and Environment on the annual performance results; give ideas on the draft Regulation on organization and organization of Council, the draft regulate functions, tasks, entitlements and organizational structure of the Assistance Office affiliated to the Council before the Minister of Natural Resources and Environment promulgates. Moreover, the National EPR Council implements other responsibilities assigned by the Minister of Natural Resources and Environment.

The National EPR Council has representatives of exporters, importers, environmental and social organizations

According to the Decision No.252/QĐ-BTNMT, the Minister of Natural Resources and Environments is Chairman of the National EPR Council. The Deputy Minister of Natural Resources and Environment is the Permanent Vice President and the Vietnam Chamber of Commerce and Industry (VCCI) is the Vice President. The Director General of Legal Affairs, the Minister of Natural Resources and Environment is the Permanent Member. The Members of the National EPR Council include representatives of the Ministries: Natural Resources and Environment, Finance, Agriculture and Rural Development, Health, Industry and Trade; representatives of the Central Committee the Vietnam Fatherland Front, the Vietnam Association for conservation of Nature and Environment, the Vietnam Association for recycling waste and the Vietnam Association for treating waste.

The National EPR Council operates on part-time basis, ensure the principle of collectives and make its decision under the majority rule; implement regulations on organization and operation promulgated by the National EPR Council. The National EPR Council is used the seal of the Minister of Natural Resources and Environment during the course of implementation the tasks, entitlements assigned by the Minister of Natural Resources and Environment.

The National EPR Council has an Assistance Office located at the Minister of Natural Resources and Environment. The Permanent Member of National EPR Council is Director of Assistance Office of the National EPR Council.

Funding for activities of the National EPR Council and an Assistance Office of the National EPR Council is implemented according to the regulations of law.
