On February 28, 2025, The Ministry of Natural Resources and Environment officially promulgated reasonable, legitimate recycling cost norms per unit mass of product and packaging (Fs) at Circular No. 07/2025/TT-BTNMT, amending and supplementing certain provisions of Circular No. 02/2022/TT-BTNMT, which details the implementation of certain provisions of the Law on Environmental Protection.

Details of the reasonable, legitimate recycling cost norms per unit of product and packaging (Fs):

Amending and supplementing “Article 78. Responsibilities of producers and importers for product and packaging recycling” as follows:

1.The reasonable and legitimate recycling cost norms per unit mass of product and packaging (Fs) are stipulated in Appendix IXa issued with this Circular.

2.Templates for implementing product and packaging recycling responsibilities:

a) Register a recycling plan for product and packaging in accordance with Form No. 01, Appendix IX, issued with this Circular;
b) Report on product and packaging recycling results (for producers and importers) in accordance with Form No. 02; Report on the results of authorized product and packaging recycling (for the authorized entities) in accordance with Form No. 02a; Report on self-implemented recycling product and packaging or contract-based recycling results (for producers, importers conducting recycling themselves and recycling units) in accordance with Form No.02b, Appendix IX, issued with this Circular;
Entities conducting self-recycling and contracted recycling units must update recycling progress monthly on the National EPR Information System in accordance with Form No.02c, Appendix IX, issued with this Circular. Updates must be completed before the 20th or the following month;
c) Declaration of the contribution amount for supporting product and packaging recycling in accordance with Form No.03, Appendix IX, issued with this Circular;
d) Declaration of the list of products and goods manufactured, imported and placed on the market in accordance with Section 1, Form 05, Appendix IX, issued with this Circular;
e) Declaration of specifications for products and packaging subject to recycling, stipulated in Form No. 06, Appendix IX, issued with this Circular. This declaration shall be submitted together with Form No. 01 and Form No. 03, Appendix IX, issued with this Circular.

3.Information on the registration and submission of recycling plans, recycling reports; financial contribution declarations for recycling support and recipient account details for financial contributions:

a) Information on the submission of recycling plans, recycling reports; financial contribution declarations for recycling support shall be sent to the Ministry of Natural Resources and Environment via the National EPR Information System;
b) The Vietnam Environmental Protection Fund (VEPF) shall provide the recipient account details and payment instructions for financial contributions supporting product and packaging recycling activities in accordance with legal regulations;
c) Financial contributions for supporting product and packaging recycling activities, when not yet disbursed, shall be deposited in commercial banks to ensure the preservation of principal and timely disbursement for supported recycling activities. The Vietnam Environmental Protection Fund shall independently decide and take responsibility under the law for selecting commercial banks for deposit.”.

Amending, supplementing: “Article 79. Responsibilities of producers and importers for waste collection and treatment”

1. Templates for implementing waste collection and treatment responsibilities:

a) Declaration of the contribution amount for supporting waste treatment in accordance with Form No. 04, Appendix IX, issued with this Circular;
b) Declaration of the list of products and goods manufactured, imported and placed on the market in accordance with Section II, Form No. 05, Appendix IX, issued with this Circular.

2. Information on the Submission of Financial Contribution Declarations for Waste Treatment Support and Recipient Account Details:

a) Submission of financial contribution declarations for waste treatment support: Submit to the Ministry of Natural Resources and Environment via the National EPR Information System;
b) The Vietnam Environmental Protection Fund provides account details for receiving contributions and the transfer details of financial contributions for waste treatment support in accordance with legal regulations;
c) Financial contributions for waste treatment support that have not yet been disbursed are deposited in commercial banks, ensuring the preservation of principal capital and timely disbursement for supported waste treatment activities. The Vietnam Environmental Protection Fund independently decides and takes responsibility under legal regulations in selecting commercial banks for depositing funds.”.
