Regulations on supplying information and monitoring natural resources and environmental data

On October 30, 2023, the Ministry of Natural Resources and Environment (MONRE) issued Circular No. 15/2023/TT-BTNMT Regulations on providing and sharing information and monitoring data on natural resources and the environment. The main point consists of 17 Articles requiring accountability for implementation. Circulars should not be used for confidential state materials.

Principles

The principles for providing and sharing databases on natural resources and environmental monitoring are in line with Article 5 of the Government's Decree No. 73/2017/ND-CP on the collection, management, exploitation, and use of data on natural resources and the environment (as Decree No. 73/2017/ND-CP).

Managing, connecting, and sharing of data under the provisions of Article 21 of Decree No. 73/2017/ND-CP, in Articles 5,23 and 45 of Government Decree no. 47/2020/ ND-CP dated April 9, 2020, on the management, connection, and share of digital data of State agencies (as Decree No. 47/2020/NĐ-CP).

Provision of open data for observation of resource and environment compliance in accordance with Article 17 of Decree No. 47/2020/ND-CP.

The shared portfolio data for resource and environmental management must be linked, mined, and shared with the System of State Agencies supporting Vietnam's E-Government growth.

Compliance with cybersecurity provisions of the legislation and rules on guaranteeing the privacy of information systems by level, organization, and individual.

Compatible with the E-Government Framework of Vietnam at the ministerial level and the province level.

The environmental resource monitoring database includes the following:

Summarise information and data on resources and the environment that is built, updated, and in for management, exploitation, and use through electronic means, including:

a) National Database;

b) Database of field environment statements;

c) Database of Ministry;

d) Provincial Database

đ) National and International Databases of organizations and individuals;

e) Open Database.

Mining, Using Information, Observation Data of Natural Resources and Environment.

The Circular states that organizations and individuals are entitled to exploit and use information and data on the environment by regulations.

If the figures from the natural resources and environmental monitoring databases are used in the electronic environment as data services via the Data Portal, proceed as follows:

a. Organizations and individuals requesting to utilize the service follow the steps on the Data Portal and are authenticated using the Electronic Identification and Authentication System.

b. Extraction, use of information, data under the duty to use data services and instructions of the data provider;

If any issues or problems arise when harvesting and using information and data, organizations and people must notify and report to the agency maintaining the natural resources and environmental monitoring database to comply with the terms of Article 10 of this Circular.

The Circular is also responsible for administering and operating a resource and environmental survey database, providing, sharing, and giving open data on resources and the environment, and guaranteeing information security.

Validity to enforcement

This Circular is effective from December 15, 2023.
