Issuance of national technical regulations for the collection, transport, storage, recycling, reuse and disposal of controlled substances

On November 30, 2023, the Ministry of Natural Resources and Environment (MONRE) issued Circular 20/2023/TT-BTNMT National technical regulations on the collection, transportation, storage, recycling, reuse and disposal of controlled substances. Issued together with this Circular is the National Technical Regulation on the collection, transportation, storage, recycling, reuse, and treatment of controlled substances code QCVN 76:2023/BTNMT, effective from May 30, 2024.

Legal grounds

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Environmental Protection No. 72/2020/QH14 dated November 17, 2020;

Pursuant to Decree No. 127/2007/ND-CP dated August 1, 2007, of the Government detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 78/2018/ND-CP dated May 16, 2018, of the Government amending and supplementing a number of articles of Decree No. 127/2007/ND-CP dated August 1, 2007, of the Government regulating detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 06/2022/ND-CP dated January 7, 2022, of the Government regulating greenhouse gas (GHG) emission mitigation and ozone layer protection;

Pursuant to Decree No. 68/2022/ND-CP dated September 22, 2022, of the Government regulating the functions, tasks, powers and organisational structure of the MONRE;

At the request of the Director of the Department of Climate Change, Director of the Department of Science and Technology and Director of the Department of Legal Affairs;

MONRE promulgates the Circular Promulgating National Technical Regulations on the collection, transportation, storage, recycling, reuse and treatment of controlled substances.

Enforcement

This Circular takes effect from May 30, 2024.

National technical regulations on the collection, transportation, storage, recycling, reuse and disposal of controlled substances

National technical regulation code QCVN 76:2023/BTNMT provides technical regulations on the collection, transportation, storage, recycling, reuse and treatment of controlled substances in Appendix III.2 and Appendix III.3 was issued together with Circular No. 01/2022/TT-BTNMT dated January 7, 2022, of MONRE detailing the implementation of the Law on Environmental Protection in response to climate change. Accordingly, the collection of controlled substances must comply with safety measures and legal regulations on fire prevention and fighting.

Specialised equipment for collecting controlled substances must be inspected and calibrated before use in accordance with the law on measurement, including:

1. A recovery machine is a device capable of recovering controlled substances with a vacuum of less than 10kPa and without the assistance of other equipment found in refrigeration and air conditioning systems.

2. Recovery containers are pressure vessels specifically used to contain controlled substances; recovery containers must meet colour coding requirements according to the 2015 Guideline K of the Institute of Refrigeration, Air Conditioning and Heating (after this referred to as AHRI) on the recovery tank of non-flammable Fluorocarbon refrigerants;
