Regulation on the sequence and procedure for determining the technology of investment projects using obsolete technology

Prime Minister issued Decision Decision 29/2023/QD-TTg dated 19/12/2023, Regulating the file, sequence and procedure for identifying investment projects using outdated technology, potential risks of environmental pollution and resource penetration.

Implementation Terms

1. The Decision will be active from February 15, 2024.

2. Ministers, Heads of Ministerial-level Agencies, Heads of Government Agencies, Chairmen of People's Committees of provinces, central cities and organisations, and relevant individuals shall be responsible for implementing this Decision.

Applicable Object

1. The lead agency organises the identification of investment projects using outdated technology, with potential risks of environmental pollution and labour intensive, under the Provisions of Points a and b, Clause 11, Article 27 of the Decree No. 31/2021/ND-CP dated March 26, 2021, of the Government, detailing and guiding the implementation of several articles of the Law on Investment.

2. Investors: Organisations that evaluate the designated machinery, equipment, and technology chain; agencies, organisations, and individuals involved.

Law on the Organization of Government of June 19 2015; Law amending and supplementing particular articles of the Law on the Organization of Government and the Law on the Organization of Local Government of November 22 2019;

Based on the Law on Investment of June 17, 2020,

Pursuant to Decree No. 31/2021/ND-CP dated March 26, 2021, of the Government detailing and guiding the implementation of particular articles of the Law on Investment;

Pursuant to Decree No. 107/2016/ND-CP dated July 1, 2016, of the Government regulating business conditions for conformity assessment services;
