What is goods destruction?

Goods destruction is the handling of a type of goods by methods in accordance with the regulations to ensure that the goods are not reused for the original purpose.


Current legal regulations on goods destruction:

  • Decree No. 38/2015/NĐ-CP on the management of wastes and scraps
  • Circular No. 36/2015/TT-BTNMT on the management of hazardous wastes
  • Circular No. 38/2015/TT-BTC dated March 25, 2015 of the Ministry of Finance on customs procedures, customs supervision and inspection, export duty, import duty, and tax administration applied to exports and imports
  • Circular No. 96/2015/TT-BTC - guidelines for corporate income tax in the government's decree no. 12/2015/ NĐ-CP dated February 12, 2015 on guidelines for the law on amendments to laws on taxation and amendments to degrees on taxation; amendments to some articles of circular no. 78/2014/TT-BTC dated June 18, 2014, circular no. 119/2014/TT-BTC dated August 25, 2014, and circular no. 151/2014/TT-BTC dated October 10, 2014 of the Ministry of Finance

Some reasons for goods to be destroyed are as follows:

Expired goods and materials;
Destruction of products temporarily imported for production in the form of temporary import for re-export, but imported raw materials are in excess or no longer manufactured;
Goods are not allowed to circulate on the market; goods have violations on tax, import and export;
 Businesses actively destroy goods due to: product line discontinuation on the market, defective goods;
Fire-damaged goods
